The points system for each state varies but a general rule of thumb you can use in order to stay on top of your driving record. Additional points for violations may be more severe when operating a commercial motor vehicle compared to his personal vehicle. A good guideline to use is calculated that points to a CMV is equal to one and a half the normal points system for a personal car. For example, in Missouri, if you are caught speeding in his personal automobile, you will receive 3 points against your driving record. If caught while driving a commercial vehicle, you could calculate that the number would increase to 4.5 points.

In general, there are variations of points a driver will receive for a speeding violation, based on the excess of miles per hour over the limit. A standard pattern is as follows:

  • Speeding – not specified MPH over = 2 points
  • 1.10 MPH over = 3 points
  • 11-20 mph over = 4 points
  • 21-30 mph over = 6 points
  • 31-40 mph over = 8 points
  • More than 40 MPH over = 11 points

Other violations can also wreak havoc on your CDL:

  • Reckless Driving = 5 points
  • Inadequate brakes = 4 points
  • Following too close = 4 points
  • Incorrect lane change = 3 points
  • Railroad Crossing violation = 3 points
  • Failure to produce / stop = 3 points
  • Other minor moving violations = 2 points

While each company of transport has its own procurement policies, on average, trucking companies require that a new employee driver has:

  • NO or not denied drug or alcohol test within the last 3 years
  • No reckless driving convictions within the last 3 years
  • NO suspension License for points in the last 3 years
  • Not more than 3 moving violations in the last year 1
  • Not more than 4 violations moving and / or accidents in the last 3 years
  • No convictions in the last 7 years
  • NO controlled substance violations the last 7 years
  • NO DWI, DUI, BAC or open container violations in the past 3 years
  • NO incarceration in the last 5 years
  • NO crimes involving dishonesty, theft or fraud – these are considered immediately disqualifying events

Graves, the major driving offenses can cause you to lose your CDL for various periods of time. These types of offenses include DUI and DWI, either alcohol or drugs, refusing to take an alcohol test, leaving the scene of an accident in CMV to commit a crime, driving a commercial vehicle with a suspended license and causing a victim death by careless driving. Any of these crimes may cause you to lose your CDL for life.

Serious traffic violations such as speeding 15 MPH or more above the speed limit, reckless driving, improper lane change and following too closely can lead to serious consequences, as well. For a second offense, you could receive a suspension of 60 days, and a third violation could result in a suspension of 120 days. Violation of an out of order service will result in a suspension of 90 days. The rape of a second time will lead a one-year suspension and a third time will result in a minimum of 3 years.

Note that if a CDL is suspended, the state can not issue a conditional license and hardship. If found guilty of rape driving, even in his personal vehicle, you must notify your employer and the points are also against their CDL. These new rules came into effect on 30 September 2005.

According to the Federal Motor Carrier Safety Administration, some of the guidelines for disqualification of a CDL is:

  • Traffic violation, 1 = 60 to 120 days of suspension
  • Two or more violations within 3 years = 90 days to 5 years
  • One or more violation of an out of service order within a period of 10 years = 1 year
  • DUI, Leaving the scene of an accident, use CMV to commit serious crimes = 3 years
  • Any of the 1-year offenses while operating Hazardous Materials = LIFE

Security and violations in motion are taken very seriously by those who are licensed to operate a CMV. As you can see, does not take much to get to 4-5 points on your driving record, professionally or personally. A ticket for speeding and failing to stop at a stop sign, could bring its CDL 7.5 points and you could be out of work.
